Exceptional Juvenile Sentence: Reduced Charges, Manslaughter Plea
Obtained exceptional sentence for juvenile client charged down from Felony Murder Second Degree for plea purposes, to plea of Manslaughter First Degree. Sentence was 22-24 months below standard range. Client pointed gun at female friend and repeatedly pulled the trigger, believing gun unloaded, which qualified for Felony Murder since pointing gun is Assault 2nd Degree. Basis: Learning disability and resulting judgment impairment following psychological examination. Judge also ruled entire sentence to be in juvenile dorm facility.
